Early Retirement Option
All full-time certificated and classified employees in good standing and receiving health benefits may elect to participate in an Early Retirement Incentive program after their 55th birthday, provided they have served the district for at least eight complete school years.
For purposes of this policy only, the following definitions shall apply:
1. Served means the employee performed his/her duties at work in full-time active service. Time in paid status outside of work (i.e., on leave) does not count toward this requirement.
2. A complete school year is one in which the employee serves (is actively serving the district and on-duty) at least 75 percent of the number of days the schools of the district are maintained.
3. An employee shall be presumed to be in good standing unless:
a. The employee has been placed on compulsory leave of absence;
b. The employee has been served with a notice of unprofessional conduct or incompetency;
c. The employee has been served with charges of suspension, demotion or dismissal; or
d. The employee has received a less-than-satisfactory evaluation in each of the two evaluations preceding the employee's retirement.
4. For employees initially employed by the district on or after July 1, 1994, a full-time employee is one who served at least seven hours per day, five days per week, and 10 months per year. For employees initially employed before July 1, 1994, a full-time certificated employee is one who served at least seven hours per day, five days per week, and 10 months per year. A full-time classified employee is one who served at least six hours per day, five days per week, and 10 months per year.
An employee's request to participate in the Early Retirement Incentive program must be made in writing by submitting an application for early retirement to the district and must include a letter of resignation for the purposes of retirement.
Notice Requirement for Classified Employees
For classified employees, the application must be submitted to the district 30 calendar days prior to the employee's desired retirement date, which date must be on or before June 30 of the year in question. The district's acceptance of the classified employee's application will automatically constitute the district's acceptance of the employee's resignation, effective on the retirement date.
Notice of Requirement for Certificated Employees
For certificated employees, the application must be submitted to the district prior to February 1 of the school year in which employee desires to retire. The district's acceptance of the certificated employee's application will automatically constitute the district's acceptance of the employee's resignation, which will be effective on June 30 of the retirement year.
This policy is meant to be utilized in lieu of the statutory Golden Handshake program.
STRS and PERS
Certificated retirees must participate in the State Teachers' Retirement System (STRS) and classified retirees must participate in the Public Employees Retirement System (PERS).
This policy shall not create any vested, contract property, or other form of rights. The district reserves the right to modify or revoke this policy and regulation at any time, for any reason, without prior notice to employees or retirees, without impairing any employee's or retiree's rights or interests. If this policy and regulation are changed, the district shall notify affected employees and retirees as soon as feasible.
